To look at why some people consider our Supreme Court Justices to be political activists, we need to look at their backgrounds - where did they come from? The following is a SHORT bio on each
Sonia Sotomayor - Yale Law School - served as a justice with the Southern District Court of New York, and the 2nd Circuit Court.
Steven Breyer - Harvard Law - served as Special Counsel to the Judiciary Committee
Samuel Alito - Princeton Law - served as Deputy Assistant Attorney General
Elana Kagan - Harvard Law - served as White House Counsel AND as special Advisor to President Clinton
Clarence Thomas - Yale Law - served as Asst. Sec. Dept of Education AND Chairman of the EEOC
Antonin Scalia - Harvard Law - served as Assistant U S Attorney General
John G Roberts - Harvard Law - served in many government positions under both Ronald Reagan and George H W Bush
Anthony Kennedy - Harvard Law - private practice attorney before being appointed the U S Circuit Court of Appeals
Ruth Bader Ginsberg - Columbia Law School - served as director of Women's Project at ACLU before being named to U S Court of Appeals
Sandra Day O'Connor - Stanford University - Arizona State Senate
David Souter - Harvard Law - New Hampshire Attorney General
John Paul Stevens - Northwestern University - U S Circuit Court of Appeals
Wiliam Rehnquist - Stanford University - U S Justice Department
What do MOST of these people have in common? That's right - they WORKED FOR THE GOVERNMENT in some capacity or other until being nominated to the SCOTUS. With the exception as Anthony Kennedy, John Paul Stevens, and Sonia Sotomayor, the last 10 Justices of the Supreme Court came directly from government jobs to the highest court in the land.
Justices on the Supreme Court are expected to be non-partisan. So WHY are they being plucked from the most partisan cesspool of America (government) to serve on the Court? How can we expect them to render a completely impartial decision when their backgrounds are tainted with political activity?
How many of you know that William Taft went from being President to being Chief Justice of the SCOTUS? Like nobody knew HIS agenda!
How many of you know that the American Bar Association has a "Standing Committee on the Federal Judiciary?" Their JOB is to evaluate potential nominees to the Supreme Court and give their evaluation to the President. Did you know that the Bar Association plays such an incredible role in determining WHO the nominee for the SCOTUS will be? Their evaluation includes confidential interviews with the prospective Justices - WAIT - isn't that the job of the Senate Judiciary Committee? Aren't THEY the ones who are supposed to determine whether or not a nominee gets approved?
All in all, considering their backgrounds, I do think that the current SCOTUS Justices have done a fair job of being impartial - in fact, there have been two unanimous decisions this term alone.
I ask you, though - WHY should our Justices come from GOVERNMENT backgrounds? Why should they have served in elected or appointed HIGHLY POLITICAL positions and then be expected to suddenly become non-partisan?
This investigation has opened my eyes. Next time there is an appointment to the SCOTUS I hope that who ever is President looks OUTSIDE government for their nominee.
